Danish national man given suspended sentence for distributing explicit film scenes on the social platform Reddit

A Denmark-based man has been convicted of sharing nude segments from copyrighted movies and television shows on the social media platform Reddit.

Based on a police report obtained by BBC News, the anonymous individual posted 347 clips of nude scenes in a subreddit he managed, which were then viewed 4.2 million times.

The country's authorities state he has been given a 7-month suspended sentence for copyright infringement.

Experts say the man was prosecuted under a rarely-used clause in Denmark's intellectual property legislation, with the judge finding that by taking the scenes out of their original context, the man had harmed the artists' "ethical entitlements".

He has additionally been convicted of sharing more than 25 TB of protected data.

From spring 2022 to May 2023, the user known as "the pseudonym KlammereFyr" on Reddit posted adult clips featuring over 100 actresses.

He distributed them in the subreddit he was a administrator of.

Per the Denmark's anti-piracy organization the Rights Alliance, his online community had more than 6,000 members and participants were encouraged to ask for clips of particular performers.

In last year, campaigners filed the case to the authorities on behalf of the impacted actors, filmmakers and producers, which resulted in the subreddit being shut down.

Andrea Vagn Jensen, among the actresses whose explicit scenes were circulated in the community, explained to local media at the period she believed there was a difference between appearing unclothed in a movie and appearing on Reddit.

The performer said the posts amounted to "abuse".

'An important message'

The man was detained in fall 2024 and pleaded guilty to the charges recently.

In a comment following the verdict, the head of the Rights Alliance Maria Fredenslund said the outcome sent an "important" signal "that violations of creators' entitlements has repercussions".

The ruling is considered unique in Denmark for its application of the "ethical protections" clause of the national copyright law, which states an artist's work cannot be used in a way which infringes upon their standing.

Copyright law expert Dr Alina Trapova told the media the legal matter was "rare" for its emphasis on the damage to the integrity of an performer, rather than to them financially.

The extent to which the ruling could influence nations abroad is uncertain.

But she added there may be "an increasing number of these actions" in the coming years with the growth of artificial intelligence, where "the sanctity of an individual's creative output might be tempered with with greater ease".
